Further Education
- Scope of Application and Subject Matter
These Terms and Conditions govern the rights and obligations of the contracting partners with regard to services provided by the University of Liechtenstein (Fürst‐Franz Josef‐Strasse, 9490 Vaduz) in respect of further education (further educationprogrammes, conferences, seminars, etc.). Only these Terms and Conditions apply unless there are relevant regulations governing specific programmes.
With the exception of any such regulations, any terms varying the Terms and Conditions must be agreed in writing and accompanied by a notice indicating that such variation of the Terms and Conditions is desired.
If there are different language versions of the Terms and Conditions, the German version will always prevail. The current Terms and Conditions are available at http://www.uni.li/legal.
The place of performance for the University of Liechtenstein is the head office of the University of Liechtenstein, namely Vaduz, Liechtenstein.
- Registering to Offerings of the University of Liechtenstein
Applicants may register to offerings of the University of Liechtenstein in writing or electronically within the prescribed registration period. The relevant date will be the date postmarked on the envelope for registrations by post and the date of receipt by the University of Liechtenstein for electronic applications. If the number of places for an event applied for is limited, applications will be ranked according to the time of receipt. An application to register to offerings of the University of Liechtenstein is binding. The contract will be concluded upon the confirmation of receipt by the University of Liechtenstein (also by e‐mail).
The University of Liechtenstein may decline requests, applications or offers. There is no legal right to participation in or provisionof services at the University of Liechtenstein. Accordingly, the University of Liechtenstein is not liable for direct or indirect costs resulting from the rejection.
Upon registration to an event, the applicant is subject to the relevant regulations of the University of Liechtenstein (especially theDisziplinarordnung (Disciplinary Code) and regulations governing specific programmes), the current versions of which areavailable on the University of Liechtenstein’s website (www.uni.li/legal).
- Attendance Fee and Methods of Payment
The attendance fee is specified for each event and can, if provided, be paid in fixed instalments. The payment of the attendance fee or that of the agreed instalments must be paid to the specified account within the prescribed time of payment after receipt of the invoice. The payer must pay any fees arising in relation to the transaction. The costs of teaching materials are included in the attendance fee. These teaching materials are made available electronically or in paper form; the form in which these teaching materials are distributed will be determined by the University of Liechtenstein. Any additional services are shown in each description of the course programme and are only included in the attendance fees if expressly so provided. The attendance fees are exempt from VAT.
In the event of late payment, the University of Liechtenstein may charge reminder charges and handling fees to the amount of 15 Swiss francs per reminder as well as default interests (4% p.a.). Reminders can be sent electronically. After the second reminder,a legal action will be brought for the amount due.
Where an invoiced attendance fee has become due, non‐payment entitles the University of Liechtenstein to cease providingservices in respect of further education including any prior booked services. The claim to the attendance fee will not be affected thereby.
- Right of Withdrawal/Cancellation and Dropout
Right of withdrawal: Consumers are entitled to withdraw from their contractual declaration within 14 days of receipt of the confirmation of registration, provided that they have made their contractual declaration by means of distance communication or neither on the premises of the University of Liechtenstein nor at a stand used by the University of Liechtenstein for this purpose at a trade fair or market. The timely dispatch of the written notice of withdrawl shall be deemed to meet the deadline.
Furthermore, withdrawal from attendance/cancellation of registration for study programmes can take place free of charge up to eight weeks before the event begins, provided that there are no special conditions set out for the relevant study programme. If theparticipant withdraws up to 30 days before the event, 30% of the total fee will be charged; and if the withdrawal takes place up to two weeks before the beginning of the study programme, 50% of the total fee will be due. Thereafter, the tuition fees are due in full and must be made in accordance with the agreed methods of payment.
Withdrawal from attendance/cancellation of other services provided in relation to further education can take place free of charge up to two weeks before the beginning of the event. In case of a withdrawal within two weeks before the beginning of the event, 50% ofthe total fee will be due; and if withdrawal takes place after the beginning of the event, the fee will be due in full. In exceptionalcases, the University of Liechtenstein can refund an attendance fee due pro rata or waive it entirely, to which there is however no legal right.
Absence without prior notice at the beginning of a further education training course will be considered as a withdrawal. In thiscase, the entire attendance fee will be due and the University of Liechtenstein will be entitled to allocate the place to another applicant.
Any attendance and tuition fees paid will only be reimbursed in the corresponding amount in case of a proper withdrawal from orcancellation of a service in respect of further education. No reimbursement or waiver of the attendance fee will be made in case of early termination of the participant’s attendance at the event for whatever reasons. The same applies to participants who are excluded from an event, due to their breach of the rules or a disruptive behaviour.
A substitute participant will be accepted at no additional cost to both study programmes and other further education services, if the required conditions for admission are fulfilled. The responsible official body at the University of Liechtenstein decides on the admission. No personal discounts automatically apply to the substitute applicant, but rather require the written approval of the University of Liechtenstein.
Notification of withdrawal must be given in writing by registered letter or e‐mail to the University of Liechtenstein. The relevant date will be the date postmarked on the envelope for registrations by post. Notifications of withdrawal by e‐mail will take effect upon receipt of confirmation by the University of Liechtenstein.
The University of Liechtenstein is entitled to exclude a participant from an event if she/he commits a breach of the relevant regulations or contract provisions, grossly disturbs an event or if it would be unconscionable to continue the contractual relationship.
- Contents of Services and Cancellations
The content and scope of various services as well as the amount of the respective fees are set out in the key documents, such as leaflets, study booklets and the like. The University of Liechtenstein reserves the right to postpone or cancel the offered service, toprovide another service equivalent in quality and price or to replace the scheduled speakers by others, in particular where the minimum number of attendees has not been met or the speaker is prevented from being present.
If a speaker is prevented from being present, the University of Liechtenstein will endeavour to find an adequate replacement. This will not give rise to any claim to reimbursement of parts of the attendance fee.
Participants cannot derive any claim (for example to travel expenses, parking fees, accommodation costs, costs incurred from timelosses) from postponements occurring during the current semester.
The participant has a claim to a confirmation of participation, provided that he/she has taken part in at least 75% of the further education training course.
- Liability and Insurance
The University of Liechtenstein does not assume any kind of liability for the content, topicality, correctness or completeness of courses, materials or documents; neither does the University of Liechtenstein assume liability for the application of the knowledgeacquired by the participants and its consequences with regard to liability.
Further, the University of Liechtenstein is liable only for damages arising due to intentional or grossly negligent conduct of employees of the University of Liechtenstein. Liability is excluded for ordinary negligence, the compensation of secondary and financial damages and the compensation of loss of profits and damages resulting from third party claims.
Any use of software or hardware made available for an event for a purpose different to that of the further education programme is forbidden and requires prior approval of the University of Liechtenstein.
Participants are responsible for taking out any further insurance (health, accident and liability insurances) required.
- Copyrights
The course materials provided as part of an event are and will remain the intellectual property of the University of Liechtenstein or the respective author. A reproduction of the documents – and any in‐ company distribution and use of the material – is subject to written consent being granted by the University of Liechtenstein or by the author.
Photos, videos or other forms of course documentation taken by participants during an event require an approval by the speaker.
Any claims for damages and injunctive relief arising upon breach of this provision remain unaffected.
- Law Applicable and Jurisdiction
The exclusive place of jurisdiction for all disputes arising from or related to services in respect of further education is the head office of the University of Liechtenstein, Vaduz, Liechtenstein.
Liechtenstein law shall be applicable to contracts concluded with the University of Liechtenstein.
